The rules for using SmartSkor

These Terms of Service ("Terms") govern your access to and use of the SmartSkor web application, websites, and emails (together, the "Service"), operated by TuneUp Fintech Finansal Teknolojileri Ltd. Şti. ("SmartSkor", "we", "us").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to enter into a binding contract to use SmartSkor.

You are responsible for the information you provide and for all activity under your account. Keep your login credentials confidential, and notify us promptly if you suspect unauthorized use. You may sign in using a third-party provider (such as Google); your use of that provider is subject to its own terms.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Service for your own non-commercial use.

You may not:

• copy, modify, distribute, sell, or lease any part of the Service or its content;
• reverse engineer or attempt to extract the source code of our software, except where the law permits;
• scrape, harvest, or systematically retrieve data from the Service without our permission;
• remove or obscure any proprietary notices; or
• use the Service to build a competing product.

SmartSkor provides data, scores, analytics, model portfolios, and related information for informational and educational purposes only. It is not investment advice, financial advice, a recommendation, or a solicitation to buy or sell any security or financial instrument, and it does not constitute investment advisory services under Turkish law or any other law.

Scores and model portfolios are generated by automated methods and may be incomplete, delayed, or inaccurate. Past performance is not a guarantee of future results, and all investing involves risk, including the possible loss of principal. You are solely responsible for your own investment decisions. Do your own research and consult a licensed financial advisor before acting on any information from the Service.

You agree not to misuse the Service. In particular, you will not:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• attempt to gain unauthorized access to the Service, other accounts, or our systems;
• interfere with or disrupt the integrity or performance of the Service;
• upload malicious code or attempt to overload our infrastructure; or
• use the Service to infringe the rights of others.

Some features require a paid subscription. We may offer free trials; unless you cancel before a trial ends, your subscription may convert to a paid plan. Fees, billing cycles, and plan features are described at the point of purchase.

Unless the law requires otherwise, fees are non-refundable. We may change our prices or plans, and we will give you reasonable notice of material changes. You can cancel at any time, and cancellation takes effect at the end of the current billing period.

The Service — including its software, scores, methodology, design, text, and logos — is owned by SmartSkor or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding. Any feedback you give us may be used without restriction or any obligation to you.

The Service relies on market data and content from third-party sources. While we work to provide reliable information, we do not control these sources and cannot guarantee that third-party data is accurate, complete, or timely. The Service may also link to third-party websites or services that we do not operate and are not responsible for.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information will be accurate or reliable.

To the maximum extent permitted by law, SmartSkor and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, or for any investment losses, arising out of or related to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or the equivalent of one hundred U.S. dollars.

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if the law requires it, or if we discontinue the Service. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will survive.

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law rules. The courts and enforcement offices of İstanbul (Çağlayan), Turkey will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, without prejudice to any mandatory consumer-protection rights you may have where you live.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
